MK Party’s Chief Whip Mzwanele Manyi says the court matter challenging the designation of the party’s Parliamentary leader, Dr John Hlophe to the Judicial Services Commission demonstrates the flaws in the country’s constitutional democracy.

The Democratic Alliance (DA), Freedom Under Law and Corruption Watch are opposed to Hlophe’s designation.

The matter sat for a second day at the Western Cape High Court.

Manyi says this is an abuse of the justice system. He says the will of the people should not be easily subjected to such processes.

“Here we have a situation where democracy took place in Parliament and processes were followed. The DA participated in the entire process; they allowed the whole thing to move on up until they lost the vote. Once they lost the vote, all of a sudden, they want to turn this court into an appeal structure of the National Assembly. This can’t be. If the DA wins this case, then it would mean that constitutional democracy is a trickery, it will therefore strengthen the case that we need a sovereign Parliament.”
