Lobby group AfriForum has instructed its legal team to investigate the merits of an application that the Independent Electoral Commission (IEC) will launch to postpone the 2021 municipal elections.

This follows IEC Chairperson, Glen Mashinini’s announcement, that the commission will follow the recommendations of former Deputy Chief Justice Dikgang Moseneke to approach the court to postpone the elections.

AfriForum’s Manager of local government affairs Morné Mostert says in a statement that it is considering presenting legal arguments if the case goes to court.

Mostert says according to the Constitution and the Local Government Municipal Structures Act, the municipal councillors’ terms cannot extend longer than five years.

He says the case could have far-reaching implications on the country’s constitution.
