ANC wins right to appeal judgment in trademark case

The ANC is heading to the Supreme Court of Appeal (SCA) to once again force the uMkhonto weSizwe (MK) Party to refrain from using the ‘uMkhonto weSizwe’ name and logo.

This comes as the High Court in Durban on Thursday granted the ANC leave to appeal the judgment in its matter against the MK Party.

In April, the High Court dismissed the ANC’s application with costs after it sought to prevent the MK Party from using the logo.

uMkhonto weSizwe, which was established as the military wing of the ANC, has since been disbanded by the party.

In granting the ANC leave to appeal, the court said it was satisfied that the appeal would have reasonable prospects of success as another court could differ from the views reached by it.

The ANC approached the High Court early this month saying, for as long as the MK Party is allowed to use the name and logo, it infringes on its trademark.

Meanwhile, if the ANC is successful in its appeal bid at the SCA, it runs the risk of stripping the MK Party which is now the third biggest political party in the country following the May polls of the right to use the name and logo.

The ANC is yet to indicate how it will proceed with the matter going forward.
