The Western Cape High Court will today hear an urgent application that the Democratic Alliance (DA) and two other organisations have brought to interdict Dr John Hlophe’s designation to the Judicial Service Commission (JSC).

The DA, Freedom Under Law (FUL) and the Council for the Advancement of the South African Constitution (CASAC) want the court to interdict Hlophe from taking up his seat on the JSC.

This is pending their review application for Hlophe’s designation to be set aside.

The applicants say the National Assembly’s decision to vote for Hlophe’s inclusion in the JSE was unreasonable and irrational.

The House voted during a plenary sitting two months ago.
