MK Party members bid to fight expulsion dismissed with costs

The Western Cape High Court has dismissed with costs an urgent interdict application by the 10 expelled uMkhonto weSizwe (MK) Party MPs.

The 10 wanted to prohibit the MK Party from fielding candidates to replace them in the National Assembly as well as prohibit Parliament from administering the oath of office pending the outcome of their review application.

They were expelled from the party last month.

The 10 MPs also wanted their benefits to be restored pending the finalisation of the review application.

Parliament had undertaken to abide by the court’s decision but legal advice pointed out that only an interdict can stop the swearing in process.

Eight new MK Party MPs were sworn in a fortnight ago.
