Mkhwebane heads to SCA today

Former Public Protector Advocate Busisiwe Mkhwebane heads to the Supreme Court of Appeal (SCA) today, to appeal the full bench judgment of the Western Cape High Court that dismissed her application with costs.

She wants the SCA to review the decisions of the Section 194 inquiry that led to her removal from office.

The former Public Protector has turned to the appeal court contending that she raised a number of crucial issues for determination by the court a quo but the judges shied away from determining the merits of the case and only gave a ruling based on what she terms as a ‘superficial technical point’.

The court, in its dismissal, found among other things, that it is only ‘in rare cases’ where grave injustice might occur, that a court will entertain an application for review before the conclusion of such proceedings.
