‘There are no constitutional reasons for Hlophe’s removal from JSC’

The lawyers representing uMkhonto weSizwe Party (MK) Member of Parliament, Dr. John Hlophe, say there are no constitutional reasons for him to be removed from the Judicial Services Commission (JSC).

They made this argument in the Western Cape High Court at the urgent Democratic Alliance (DA) application interdict for Hlophe not to be recognised as the parliamentary representative in the JSC.

Senior Counsel, Adv. Thabani Masuku says, “The only qualification they can have is that they are the members of the National Assembly, only qualification nothing else.”

“The second qualification under Section 178 is that three of whom and this is very important must and this is a mandatory requirement, must be members of the opposition parties represented in the National Assembly. That is what Anton Katz was talking about. The Constitution tells the National Assembly that of the sixty people, that three of them must come from the opposition parties.”
