Arguments against SABC’s use of term “GNU” continue in court

The legal counsel for former President Jacob Zuma and the uMkhonto weSizwe Party has argued that the matter before the Gauteng High Court in Johannesburg is about the constitutional obligations of the South African Broadcasting Corporation (SABC).

Zuma and the MK Party are seeking a declaratory order to have the SABC’s use of the term ‘Government of National Unity’  (GNU) declared unconstitutional and invalid.

The applicants argue that the current political arrangement does not fit the definition of a GNU.

Advocate Dali Mpofu says the SABC is an organ of state and therefore seeks to enforce rights.

“ It’s not about the GNU. It’s about the SABC and about the constitutional obligations of a public broadcaster which is an organ of state. The product that this organ of state produces is of no major significance. The rights that we want to enforce qua organ of state are those rights that reside in Section 33 of the Constitution but as far as the so-called declaratory order is concerned, then it is the other rights. “
