The African National Congress (ANC) says allowing the uMkhonto weSizwe (MK) Party leader in Parliament Dr John Hlophe to sit in the Judicial Service Commission (JSC) is an indictment and immoral.

Despite being impeached by Parliament as a judge, Hlophe was nominated by his party to be part of the parliamentary panel that interviews the prospective judges.

The ANC says if there was a vote to oppose that, it would have voted against his nomination.

ANC Secretary General Fikile Mbalula says that as much as they voted for Hlophe’s impeachment they would have voted against his inclusion in the JSC.

” The discontent about John Hlophe’s nomination is valid. If were to vote we would vote for him to go out. What our Chief Whip said, the rules in terms of eligibility of a member to stand are mute when it comes to an individual who is impeached. So it is on the shoulders of parliamentarians to rectify this thing. It would be an indictment if this were to allow, a man who was a judge and impeached and found to be on the wrong. He must now sit in the panel and judge others and question them. It is morally bankrupt and incorrect, it must be corrected by the same Parliament.”
